Part 1 – General Part – Information regarding the operation of the website

The laruchegolden.ma website is managed and operated by the company La Ruche Golden SARL, whose head office is located at HY MLY RACHID BLOC 10 NR 16 LAAYOUNE, Morocco and registered in the Trade and Companies Register under SIREN number: 893637488. In our dealings with our customers, we always seek suitable and flexible solutions, even when it comes to legal issues. In case of difficulties, please contact our customer service. If an amicable solution cannot be found, you will of course retain all your rights. You will find below all the contractual terms and conditions as well as our general terms and conditions of sale.

1. SCOPE / DEFINITIONS

1.1 These general terms and conditions of sale apply, in their version in force at the time of the order (hereinafter GTC), to all orders placed by any person (hereinafter "you") via the website www.laruchegolden.ma with the company La Ruche Golden SARL (hereinafter "we"). You declare that you have read and accepted the GTC as well as the rights and obligations arising therefrom before placing your order. Validation of your order therefore constitutes acceptance of the current GTC. All our deliveries, services and offers are exclusively governed by these GTC, unless expressly agreed otherwise in writing. We object to any general or specific conditions that are contrary to or deviate from these conditions.

1.2. The term "consumer" used in these GTC means a natural person placing an order that does not fall within the scope of their commercial or professional activity. A "professional" within the meaning of these GTC is a natural or legal person who, when placing an order, acts within the scope of and on behalf of their commercial or professional activity. The term "customer" may refer to both a consumer and a professional.

1.3. The term “working day” within the meaning of these T&Cs means all days of the week with the exception of Saturdays, Sundays and public holidays.

2. DOWNLOAD AND CONSULTATION OF CONTRACTUAL PROVISIONS

2.1. You can consult these General Terms and Conditions at any time on our website laruchegolden.ma. You can print or save this document. You can also archive the contractual conditions of your order by downloading the General Terms and Conditions and saving either the summary of your order in the online store using your browser or the order confirmation email that is automatically sent to you after your purchase at the email address you provided. This order confirmation contains your order references and a link to consult these General Terms and Conditions. The order confirmation can be saved or printed using the corresponding function in your email.

2.2. Your order data is stored in our system. We offer each customer access to their customer account, protected by a password (click on "my account"). Once your customer account has been created, you can find out about orders placed, in progress or recently shipped and manage and save information about you (postal address, telephone number, bank details) and subscribe to our newsletter or unsubscribe from it. You agree to keep your customer account access data confidential and in particular not to disclose them to third parties.

2.3. We reserve the right to adapt or modify these T&Cs at any time and without notice. In this case, the adaptations or modifications will be applicable to all orders placed from the publication of the modified T&Cs on the site on which you make your purchase.

3. CONCLUSION OF THE SALES CONTRACT

3.1. On the laruchegolden.ma website, contracts are concluded exclusively in French. Product offers are not intended for minors under 18 years of age. Minors may only place orders with the authorization of their legal representatives.

3.2. Product offers are valid as long as they are visible on the site in question, within the limit of available stocks. In the event of unavailability of the product, we will inform you by email as soon as possible and will offer you either a product of equivalent quality and value or the cancellation of your order. In the event of cancellation of the order, the sums you have already paid will be refunded to you within thirty (30) days following the cancellation of the order. Beyond this period, the sums paid will be productive of interest at the legal rate in force.

3.3. After selecting the desired product(s), you fill out an order form and must click on the "next" icon. After that, you will have the opportunity to check the specifics of the order and modify it. The "confirm order" button allows you to confirm your order for the goods contained in the basket, the order then becomes final. We will acknowledge receipt of your order by an order confirmation sent automatically by e-mail to the address you have indicated.

3.4. Any placing of an order constitutes acceptance on your part of the prices and descriptions of the products that you have placed in the basket.

3.5. If a due payment is not made within three (3) weeks of sending the order confirmation despite one or more reminders by e-mail (the first of which is usually sent six days after the order), we are entitled to declare the unilateral termination of the contract and thus cancel the order. In the event of termination of the contract, we are no longer obliged to deliver the ordered goods; no rights will arise from the contract for either party. This means that the items ordered will be reserved for you for a maximum period of seventeen (17) days from the order.

4. PAYMENT / DELIVERY

4.1. Unless otherwise expressly agreed in writing, the price is payable in cash, in full on the day the order is placed. The seller is not required to deliver the products ordered by you if the price has not been paid in full in advance. Unless otherwise stipulated, the seller does not grant any discount.

4.2. At the end of the ordering process, you may be offered different payment methods to pay for your purchases. Depending on the result of the analysis of the trust level of the transaction, we reserve the right not to offer you certain payment methods.

4.2.1 Delivery time:

  • Standard delivery to Morocco - 5 to 10 working days
  • Express delivery to Morocco - 3 to 5 working days

These times are calculated from the date of dispatch and are understood to be in working days from Monday to Friday. However, please note that we reserve the right to delay the preparation of your order if this is necessary to improve the overall management of our stocks and orders.

4.2.2. Responsibility for delivery delays:

The delivery of your order is a step that is the responsibility of third parties independent of La Ruche Golden. Therefore, we inform you that we cannot be held responsible for any delays caused by the carrier or courier. In such cases, we will not be able to cancel the order, make a refund or offer compensation.

4.2.3. Liability in the event of loss, theft or non-trace of the package:

We do our best to ensure the safe delivery of your order. However, once the carrier reports the package as delivered in the tracking history, we are not responsible for any loss, theft or untracked parcel. In such situations, we will not be able to cancel the order, issue a refund or offer compensation.

4.3. Whatever payment method you choose, any payment will only be considered final after actual and complete collection of the sums by us. We only accept payments from Morocco. We do not cover the costs relating to payments from third countries.

4.4. You agree to receive your invoices exclusively in electronic form.

4.5. In the context of a sale to a professional, late payment penalties will be payable the day following the payment date shown on the invoice. The rate of these penalties is three (3) times the legal interest rate.

4.6. The ordered products will be sent to the address you provided during the ordering process. We are not responsible for delays in delivery caused by you providing an incorrect or incomplete address.

4.7. When the seller is prevented from performing the contract by a case of force majeure or an unforeseeable event as defined by Moroccan case law or by an external cause, in particular a fault attributable to you, the delivery period is automatically extended according to the duration of the impediment. We will inform you by e-mail of the occurrence and end of such impediments. If the impediment lasts more than four (4) weeks, each party will have the right to terminate the contract automatically, without you being able to claim compensation from us.

4.8. If you are a consumer, the transfer of risks occurs at the time of delivery of the products to the delivery address you provided or at the time of collection of the package from the carrier. If you are a professional, the transfer of risks occurs at the time of dispatch of the goods by us.

5. RETENTION OF TITLE

5.1. The Seller reserves ownership of the delivered goods until full payment of the order amount.

5.2. The aforementioned retention of title clause does not prevent the risks of loss or deterioration of the goods from being borne by you as soon as they are made available (for consumers) or as soon as they are sent (for professionals).

6. INTELLECTUAL PROPERTY

6.1. The site laruchegolden.ma is an intellectual work protected by law. Their content, including texts, illustrations, photographs, presentations and databases are strictly reserved under copyright and industrial property law. We grant you a limited, non-exclusive, revocable license, without the right to sublicense on the content of the site laruchegolden.ma for simple access, navigation and use related to this site. This license does not grant you any other right, in particular commercial exploitation of the content of the site laruchegolden.ma.

6.2. The company names, brands and distinctive signs appearing on the site laruchegolden.ma are protected by Moroccan and international laws. Any use, reproduction, distribution or representation of all or part of one of the aforementioned signs without the express written authorization of the relevant owner is prohibited.

7. LEGAL WARRANTY AND CUSTOMER SERVICE

7.1. In the event of defects in the goods, you benefit from the legal guarantees provided for by the legislation in force.

7.2. The satisfaction of our customers is important to us. You can contact us at any time using the customer service contact details listed above. We will review your request as soon as possible and contact you after receiving the documents and/or your request or complaint. Processing complaints may take some time, as it often involves contacting the manufacturer of your product. You can facilitate the processing of your complaint by describing the problem as accurately as possible, and by sending us a copy of the invoice or by providing us with the order references (order number, customer reference, etc.). If we do not respond within five (5) working days, we invite you to contact us again. Indeed, it may happen that some emails are blocked by the spam filter of our computer system.

8. APPLICABLE LAW, COMPETENT COURTS

8.1. The contractual relations between us and our consumer customers are exclusively subject to Moroccan law.

8.2. In contractual relationships with our business customers, the courts of the jurisdiction of our registered office shall have exclusive jurisdiction. However, we reserve the right to sue the business customer before the courts of its registered office.

9. SAFEGUARD CLAUSE

If any provision of these T&Cs were or became void or unenforceable, the validity of the other provisions would not be affected. The void or unenforceable provision would then be replaced by the applicable legal provisions.

Part 2 – Ordering Items laruchegolden.ma

1. SELLER INFORMATION

When ordering items from laruchegolden.ma, the seller is La Ruche Golden SARL, HY MLY RACHID BLOC 10 NR 16 LAAYOUNE, Morocco.

2. PRICES AND DELIVERY COSTS

We reserve the right to change prices at any time, but the products will in any case be invoiced on the basis of the rates in force at the time the order is placed. The price indicated in our order confirmation is the final price expressed in Moroccan Dirhams, all taxes included at the legal rate in force. It includes delivery costs.

3. PAYMENT, DELIVERY

3.1. At the end of the ordering process, the following payment methods may be offered to you to pay for your purchases: Visa, PayPal, Mollie, MasterCard, Amex.

3.2. We use local carriers for deliveries in Morocco. If the recipient is absent when our transport provider visits, the package will be left at a post office near the delivery address. For deliveries to one of the merchants in the carrier network, the customer can collect the package within 10 working days upon presentation of an identity document and, in the case of home delivery, the delivery notice. At the end of this period, unclaimed packages will be returned to us. We decline all responsibility for delays in delivery caused by the absence of the recipient of the package or their failure to collect it within the time period provided for this purpose.

You must be vigilant and check the address provided before confirming your order, as you will be held solely responsible for the consequences resulting from any input error on your part and the costs associated with it, in particular the reshipping costs which will be your responsibility and will not be assumed by La Ruche Golden.

3.3. La Ruche Golden will make every effort to ensure that your order is shipped within these time limits. You may request in writing the termination of the sale only if the delivery delay exceeds 30 days from the date of the order. It will then be up to La Ruche Golden to refund the sums paid to you no later than fourteen days following the date of termination of the contract, excluding any compensation or deduction. The termination of the sale will not be accepted if the delay or failure to deliver occurs due to the consumer, carrier or a case of force majeure. You are required to check the condition of your package in the presence of the delivery person in order to issue reservations on the delivery note or to refuse the product if you notice any apparent defect or non-conformity or in the event of a missing product. From the delivery, you have 3 working days to send your complaint to La Ruche Golden in writing (by post or email). You must attach to your request all supporting documents, including photos proving the subject of your claim. If the claim is not made within these time limits and conditions, it will be refused by La Ruche Golden and the products will be deemed compliant and free from any apparent defect. You may request a replacement of the product, which will be the responsibility of La Ruche Golden, for any product delivered, whose lack of conformity or apparent or hidden defects have been duly proven by the consumer, under the conditions provided for by Moroccan legislation.

4. RIGHT OF WITHDRAWAL

4.1. WITHDRAWAL

In accordance with current legislation, the consumer has a period of fourteen clear days to exercise his right of withdrawal without having to provide reasons or pay penalties, with the exception, where applicable, of return costs. The period mentioned runs from the day of receipt of your order.

To exercise this right, you must notify us, by post or email to the following email address: laruchegolden@gmail.com , of your wish to withdraw, specifying:

  • Your order number
  • Your first and last name
  • Your address
  • Your phone number
  • Your email address

You can use the withdrawal form that you will find in the appendix at the bottom of the page of these General Terms and Conditions. In the event of a dispute, it is up to you to prove that you have respected the aforementioned withdrawal period.

We inform Customers that this right of withdrawal cannot be exercised for:

  • Cosmetic products that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection.

In the event of exercising the right of withdrawal within the aforementioned period, only the price of the product(s) purchased will be refunded, the shipping, preparation and return costs remain the responsibility of the Customer and will be deducted.

4.2. RETURN

To be accepted by La Ruche Golden, the return must meet the following conditions:

  • Products must be returned to us no later than 14 days after receipt of your order.
  • The products must be returned in their original condition and complete (packaging + accessories, instructions, etc.) allowing them to be put back on the market in new condition.
  • Products must not be used, damaged, soiled or incomplete.

You must return the package to the following address: Contact us via the after-sales service address to obtain the return address. You must return the package by post using Colissimo to the above address.

When the conditions specified above are met, upon receipt of the return and after checking the condition of the returned product, La Ruche Golden will reimburse you, within 14 days of receipt of your return, the full amount paid, excluding delivery costs. The costs and risks of the return are your responsibility. La Ruche Golden will reimburse you using the same means of payment as that used for the initial purchase.

4.3. Return to sender:

If the package is refused, unclaimed or not delivered due to the consumer, no refund will be made and the cost of returning the package will be the responsibility of the customer.

4.4. In the event that the package is returned to the sender (to us) due to an address error, refusal of the package, absence of the customer or for any other reason, no refund will be made and the cost of returning the package will be borne by the customer.

5. CONDITIONS OF USE FOR DISCOUNT COUPONS

The provisions of this article apply only to discount coupons distributed free of charge.

5.1. laruchegolden.ma may distribute coupons entitling you to a reduction in the price of a purchase, either in absolute value or as a percentage. Each discount coupon specifies the minimum purchase amount, the online store in which the coupon can be used and the coupon's validity date. Certain products and brands may be excluded from the benefit of discount coupons.

5.2. The credit materialized by the reduction coupon does not produce interest, cannot be reimbursed and is not transferable to third parties.

5.3. It is not possible to use multiple discount coupons for a single order.

5.4. The difference between the amount of the discount coupon and the value of your order can be settled by any means of payment offered on the site.

5.5. In the event of a total or partial return of the goods, the fraction of the price paid by discount coupon is not refunded.
